A Posthumous Oscar for Heath?

Here is something I've been pondering: would the Academy consider giving Heath Ledger a posthumous Oscar for his portrayal of The Joker in the upcoming film, The Dark Knight? There is precedence for actors being nominated for an Oscar posthumously, most notably James Dean who was nominated for two Oscars after dying in a tragic motorcycle accident. Peter Finch won the Best Actor award posthumously for his performance in Network.

This film isn't even out yet, and I have only seen Ledger's performance in the trailers, but these are the things I think about. I guess I'm not the only one.
